Lawmakers have viewed a DPS video of the fatal shooting of two Guatemalan immigrants in a chase along the border.

The two state lawmakers who saw the video say it supports DPS statements about what happened when a sniper in a helicopter fired on a truck suspected of carrying drugs.

State Senator “Chuy” Hinojosa from McAllen sits on a committee that overseas the department of public safety, and he says at no time did the tarp come off or expose any immigrants.

State Rep. Lon Burnam from Fort Worth, who also shares oversight of DPS agrees, but he is troubled by what he saw in the video.

Burnam says we have to do a better job of defining when it is acceptable to shoot at a moving vehicle.

DPS says the sniper fired on the pickup to disable it as it neared a school.

Due to the deaths of two people, a hidalgo county grand jury is now investigating the case.
