Former coach and Katy football star David Temple is denied a new trial by the Texas supreme court. Temple is convicted of killing his wife in 1999, but claims new evidence shows he is innocent of the crime.
Former prosecutor and Crime Stoppers director Katherine Cabaniss, however, says the decision is expected because the judge cannot rule on the motion with an appeal pending.
Judge David Mendosa said he was not ruling on the merits of the motion, only that he has no jurisdiction.
Temple’s attorneys are asking the appeals court to confirm this, saying they’ll take it as far as they can.
